1. Introduction and Agreement
This Website, located at http://alter-vista.co.uk, is owned and operated by Olga Chekmazova (The Artist).
By accessing or using our Website, viewing the content, or making an enquiry or purchase, you ("The Client," "You," or "Your") agree to be legally bound by these Terms and Conditions and our separate Privacy Policy and Cookie Policy. If you do not agree to these terms, you must not use this Website.

  • Governing Law and Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
2. Intellectual Property and Copyright
2.1 Website Content
All content on this Website (including images, text, design, and graphics) is the intellectual property of the Artist. You may not reproduce, copy, or distribute any part of the Website content without our express written permission.
2.2 Artwork Copyright
The purchase of an original work of art (or a print/reproduction thereof) DOES NOT transfer the copyright of the Artwork to the Client.
  1. Retention: Copyright, moral rights, and all reproduction rights remain the sole and exclusive property of Olga Chekmazova (The Artist).
  2. Reproduction: The Client is strictly prohibited from creating any copies, reproductions, or images of the Artwork for commercial use, publication, or resale without the Artist’s express written licence.
  3. Artist's Right: The Artist retains the right to use images of the sold Artwork for promotion, marketing, and display (online and offline portfolios).
3. Orders, Prices, and Contract Formation (Hybrid Sales Model)
3.1. Pricing and Availability
  1. Fixed Prices (Invitation to Treat): For certain Artwork, the price is clearly displayed on the Website. The display of a price and the Artwork constitutes an invitation to treat and not a contractual offer to sell.
  2. Price on Application (POA): For all other Artwork, the price is available upon request (POA).
  3. Pricing Changes: All prices are subject to change without notice. The final price is only confirmed upon the issuance of an official Invoice to the Client.
3.2. Contract Formation (All Sales)
Crucially, no purchase contract is formed through the Website itself. All sales are finalised off-site via written correspondence.
  1. Client Offer: When the Client expresses interest in purchasing a specific Artwork (whether the price is displayed or requested via POA) and confirms their intent to buy (via email to alter.vista.olga@gmail.com or other written contact), this is considered the Client's initial offer to purchase.
  2. Artist's Acceptance (Contract): The contract of sale is legally formed only when the Artist accepts the Client's offer by sending an official, written Invoice and Order Confirmation via email, and full payment has been successfully received by the Artist.
3.3. Pre-Contract Information
For all sales, the final legal information (including the total price, shipping costs, and delivery timeline) will be clearly set out in the Invoice and Order Confirmation before payment is requested, as required by the Consumer Contracts Regulations 2013.
4. Pre-Contract Information and Delivery
The final contractual details will be set out in the Invoice, but the following mandatory information applies to all distance sales contracts under The Consumer Contracts Regulations 2013:

All applicable delivery charges will be calculated individually and stated in the Invoice prior to payment.

Delivery Time

We aim to dispatch the Item within [3-5 working days] after receiving payment. In any case, delivery will be made no later than 30 days from the date of the contract (Invoice payment date), unless otherwise agreed.

5. Returns, Cancellations, and the Cooling-Off Period
5.1. Right to Cancel
As a consumer, you have the right to cancel your contract and return the purchased Artwork within 14 calendar days from the day you received the goods (the "Cooling-Off Period").
  • Exceptions: This right to cancel generally does not apply to custom-made or commissioned Artwork produced specifically to the Client's specifications.
5.2. Return Procedure
  1. Notification: You must notify us in writing (via email to alter.vista.olga@gmail.com) of your intention to cancel and return the Artwork within the 14-day period.
  2. Return Costs: You are responsible for the direct cost of returning the Artwork (the return shipping cost).
  3. Condition: The Artwork must be returned to the Artist at the Client's expense, in the same condition in which it was received, suitably packaged and insured against damage.
  4. Refund: A full refund (excluding the original shipping costs) will be processed within 14 days of the Artist receiving and inspecting the returned goods.
6. Limitation of Liability and Guarantees
  1. Statutory Rights: Nothing in these Terms limits or excludes any liability that cannot be legally limited or excluded under UK law, including liability for death or personal injury caused by negligence or the statutory rights guaranteed to consumers under the Consumer Rights Act 2015.
  2. Accuracy: The Artist makes every effort to display the Artwork and colours accurately, but due to variations in monitor settings, the actual colours may vary slightly.
  3. Limitation: The Artist’s total liability to you in respect of any losses arising under or in connection with the contract shall not exceed the total price paid by you for the Artwork.
7. Suspension and Termination
We may terminate or suspend your access to our Website immediately, without prior notice or liability, if you breach these Terms and Conditions. Upon termination, your right to use the Website will cease immediately. Any provision of these Terms which, by its nature, should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
8. Indemnity
You agree to indemnify, defend, and hold harmless Olga Chekmazova (The Artist) and its affiliates from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Website, or your breach of these Terms.
