2. Intellectual Property and Copyright
2.1 Website Content
All content on this Website (including images, text, design, and graphics) is the intellectual property of the Artist. You may not reproduce, copy, or distribute any part of the Website content without our express written permission.
2.2 Artwork Copyright
The purchase of an original work of art (or a print/reproduction thereof)
DOES NOT transfer the copyright of the Artwork to the Client.
- Retention: Copyright, moral rights, and all reproduction rights remain the sole and exclusive property of Olga Chekmazova (The Artist).
- Reproduction: The Client is strictly prohibited from creating any copies, reproductions, or images of the Artwork for commercial use, publication, or resale without the Artist’s express written licence.
- Artist's Right: The Artist retains the right to use images of the sold Artwork for promotion, marketing, and display (online and offline portfolios).
3. Orders, Prices, and Contract Formation (Hybrid Sales Model)
3.1. Pricing and Availability
- Fixed Prices (Invitation to Treat): For certain Artwork, the price is clearly displayed on the Website. The display of a price and the Artwork constitutes an invitation to treat and not a contractual offer to sell.
- Price on Application (POA): For all other Artwork, the price is available upon request (POA).
- Pricing Changes: All prices are subject to change without notice. The final price is only confirmed upon the issuance of an official Invoice to the Client.
3.2. Contract Formation (All Sales)
Crucially, no purchase contract is formed through the Website itself. All sales are finalised off-site via written correspondence.
- Client Offer: When the Client expresses interest in purchasing a specific Artwork (whether the price is displayed or requested via POA) and confirms their intent to buy (via email to alter.vista.olga@gmail.com or other written contact), this is considered the Client's initial offer to purchase.
- Artist's Acceptance (Contract): The contract of sale is legally formed only when the Artist accepts the Client's offer by sending an official, written Invoice and Order Confirmation via email, and full payment has been successfully received by the Artist.
3.3. Pre-Contract Information
For all sales, the final legal information (including the total price, shipping costs, and delivery timeline) will be clearly set out in the
Invoice and Order Confirmation before payment is requested, as required by the Consumer Contracts Regulations 2013.
4. Pre-Contract Information and Delivery
The final contractual details will be set out in the Invoice, but the following mandatory information applies to all distance sales contracts under
